Court Keeps 423.5 Billion Won Fine on Coupang Over Data Breach - Seoul Economic Daily
A South Korean court has declined to suspend a 423.5 billion won ($290 million) fine imposed on e-commerce giant Coupang over a massive data breach affecting 37.55 million people.
The Seoul Administrative Court's Fourth Division, presided over by Chief Judge Kim Young-min, partly rejected Coupang's request for a stay of execution against the commission's decision. The court ruled that the damage from the fine appears recoverable through monetary compensation and that evidence was insufficient to establish the fine would cause irreparable damage.
Court Decision Details
The data breach exposed personal information of approximately 37.55 million individuals. While the court upheld the financial penalty, it suspended corrective and disclosure orders until 30 days after the main case ruling.
There is a risk of damage that would be difficult for the applicant to repair, and an urgent need to suspend their effect to prevent it.
Legal Proceedings Continue
The current decision only addresses Coupang's request for a stay of execution. A final judgment on the legality of the fine and other measures will be made in the main lawsuit, which seeks to cancel the penalty and corrective actions. The suspension of disclosure orders suggests the company may face additional scrutiny over its data handling practices.
