Hong Kong's Legislative Council passed its crypto tax reporting bill on November 4, 2026, requiring service providers to begin collecting information in 2027 ahead of international exchanges starting in 2028.

The legislation implements the Organisation for Economic Co-operation and Development's Crypto-Asset Reporting Framework (CARF), alongside amendments to the Common Reporting Standard. It covers more than just buying and selling coins for cash, extending to transfers of relevant crypto-assets and tokens representing property or other rights.

The bill published by the Inland Revenue Department puts the CARF provisions into operation on January 1, 2027. Providers will collect the information specified by that framework during 2027, with the department beginning exchanges with partner jurisdictions from 2028.

Implementation Timetables

The amended Common Reporting Standard has a separate timetable, taking effect in 2028, followed by automatic exchanges of financial account information under the updated standard from 2029. The government states these amendments cover digital financial products and enhance reporting and due-diligence requirements.

Hong Kong confirms the exchanges will be reciprocal and subject to data confidentiality and security. The statutory definitions distinguish partner jurisdictions from reportable jurisdictions, with the Commissioner able to specify each through published lists.

Provider Definitions and Nexus Rules

A reporting crypto-asset service provider is defined as an individual or entity that carries on a business executing exchange transactions for or on behalf of customers. This includes acting as the counterparty, intermediary, and making a trading platform available.

Nexus rules connect providers to Hong Kong through tax residence, an entity managed from Hong Kong, a regular place of business there, or incorporation under Hong Kong law. A Hong Kong branch can also bring a provider within the framework when relevant transactions are executed through that branch.

Asset and Transaction Coverage

The asset definition includes cryptographic tokens representing membership claims, property rights and other rights that can be digitally exchanged for fiat currency or other crypto-assets. Exclusions cover central bank digital currencies, specified electronic money products, and assets that providers determine cannot be used for payment or investment.

The government says the Inland Revenue Department has established a dedicated team to answer industry questions and provide technical support. The department will issue implementation guidance, but the passage announcement neither supplies that guidance nor resolves the classification of individual tokens and platforms.

Hong Kong Government

A relevant transaction can be an exchange or a transfer, with the latter covering movements to or from a user's crypto-asset address where the provider cannot determine if it's an exchange. Moving assets to an external wallet falls within transaction categories even when not selling them.
